Terms of Service

1. Acceptance of Terms

By creating an account or using the Wayform platform (the “Service”), operated by Abilene Christian University’s Center for Vocational Formation (“we,” “our,” or “us”), you agree to these Terms of Service (“Terms”). If you do not agree, do not use the Service.

We may update these Terms from time to time. Continued use of the Service after the effective date of any revision constitutes your acceptance of the updated Terms.

2. Accounts

• You must be at least 13 years old to create an account.
• You are responsible for maintaining the security of your account credentials.
• You must provide accurate information when creating your account and keep it up to date.
• You may not share your account with others or create accounts for others without authorization.
• We reserve the right to suspend or terminate accounts that violate these Terms or that we reasonably believe pose a security risk.

3. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable laws or regulations.
• Post, transmit, or share content that is abusive, harassing, threatening, obscene, defamatory, or otherwise objectionable.
• Impersonate any person or entity or misrepresent your affiliation with any person or entity.
• Attempt to gain unauthorized access to any portion of the Service or its related systems.
• Scrape, crawl, or systematically extract data from the Service without express written permission.
• Use the Service to distribute spam or unsolicited commercial communications.
• Interfere with or disrupt the integrity or performance of the Service.

4. Course Content & Enrollment

• Access to courses is granted subject to enrollment eligibility determined by your institution or cohort.
• Course content is provided for personal, non-commercial educational use only.
• You may not reproduce, redistribute, or resell course content without prior written consent.
• We reserve the right to modify, suspend, or discontinue any course at any time.

5. Intellectual Property

All content on the Service — including course videos, text, graphics, logos, and software — is owned by or licensed to Abilene Christian University and is protected by applicable intellectual property laws. Nothing in these Terms grants you any right to use our trademarks, logos, or other proprietary materials without our prior written consent.

You retain ownership of content you submit to the Service (such as community posts). By submitting content, you grant us a non-exclusive, royalty-free, worldwide license to use, display, and distribute that content within the Service.

6. Community Standards

Wayform includes community discussion features. You agree to engage respectfully and in a manner consistent with Christian values of dignity, honesty, and grace. We reserve the right to remove content and/or suspend accounts that violate our community standards or that we determine, in our sole discretion, are harmful to the community.

7. Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

8. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE SIX MONTHS PRIOR TO THE CLAIM OR (B) ONE HUNDRED DOLLARS (USD $100).

10. Governing Law

These Terms are governed by the laws of the State of Texas, without regard to its conflict of laws provisions. You agree to submit to the exclusive jurisdiction of the courts located in Taylor County, Texas for the resolution of any dispute arising from these Terms or the Service.

11. Termination

We may terminate or suspend your access to the Service at any time, with or without cause or notice, without liability to you. Upon termination, all rights granted to you under these Terms immediately cease. Provisions that by their nature should survive termination shall survive (including Sections 5, 8, 9, and 10).
